The Supreme People’s Court Released its 2008 Top 10 IPR Protection Cases

On April 21, the Supreme People’s Court released the 2008 Top 10 IPR Judiciary Protection Cases, including 7 civil cases, 2 criminal cases and 1 administrative case, among which are 3 copyright case, 3 trademark cases, 2 patent cases, 1 new varieties of plant case and 1 domain name infringement case.

The Top 10 IPR Protection Cases are:

1. Porsche Automobile Co., v. Techart Automobile Service Co., Ltd copyright infringement case;
2. Huang Zixiu v. Nanning Art Theatre copyright infringement case;
3. Ritz Hotel, Limited v. Shanghai Huangpu Lichi Leisure and Fitness Co., Ltd. trademark infringement case;
4. Henan Zhenglong Food Co., Ltd. (Baixiang) v. Sichuan Baijia Food Co., Ltd. and Henan Silin Department Store Co., Ltd. trademark infringement case;
5. Jiangsu Baite Export-Import Trading Co., Ltd. and Jiangsu Huaian Kangbaite Carpet Co., Ltd. v. Xu Zanyou intellectual property related dispute case;
6. Hefei Xinqiang Seed Technology Co., Ltd. v. Anhui Chuangfu Seed Co., Ltd. new plant infringement case;
7. Hangzhou Dukuai Internet Media Co., Ltd. v. Wang Linyang internet domain name infringement case;
8. Jining Pressureless Boiler Company v, the Patent Reexamination Board of SIPO and Shu Xuezhang patent invalidation case;
9. Xiapu Huafeng Machine Co., Ltd. and Zeng Fengxi trademark passing-off case;
10. Xu Chufeng and Jiang Haiyu copyright infringement case.
